2. Account Eligibility and Registration

To access and use the service, you must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater) and must not be restricted from receiving the service under the laws of any applicable jurisdiction. By creating an account, you represent and warrant that all registration information provided is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Sharing account access, credentials, or virtual numbers with unauthorized third parties is strictly prohibited. We reserve the right to refuse registration or terminate any account at our sole discretion, without obligation to provide reasons.

3. Permitted Use

The service is strictly limited to receiving SMS verification codes. Any usage outside this expressly permitted scope constitutes a material breach of these Terms, resulting in immediate suspension without support or refund.

4. Prohibited Uses

The user acknowledges and agrees that the service shall not be used for any unlawful, fraudulent, or malicious purposes, including but not limited to:

• Financial fraud (card cloning, embezzlement, money laundering);
• Creation of fake accounts for criminal or deceptive purposes;
• Phishing, spear-phishing, or identity theft;
• Dissemination of spam, malware, or unsolicited communications;
• Violation of third-party privacy or intellectual property rights;
• Transaction disputes (fraudulent chargebacks) or payment evasion.
• Use of automated scripts, bots, or other programmatic tools to circumvent usage controls, manipulate number availability, or artificially inflate system load;
• Redistribution, resale, or sublicensing of virtual numbers, account access credentials, or received SMS codes to third parties through channels other than the platform's official API or authorized reseller integration;
• Any attempt to reverse-engineer, decompile, disassemble, scrape, or otherwise extract non-public technical components of the platform, or to circumvent its access controls;
• Use of the service in any manner that violates applicable telecommunications regulations, including unauthorized commercial messaging, SMS pumping, or artificial traffic inflation.

Any violation of these prohibitions constitutes a material breach and will result in immediate termination of the account and forfeiture of any remaining balance, without prejudice to our right to pursue applicable legal remedies.

5. Anti-Abuse and Misuse Controls

To maintain platform integrity and equitable access for all users, automated monitoring systems are in place to detect anomalous usage patterns. The following behaviors are considered misuse and may trigger immediate account restrictions or permanent suspension:

• Repeatedly purchasing and cancelling virtual numbers without a legitimate attempt to receive an SMS code;
• Systematic bulk acquisition of numbers inconsistent with normal individual use;
• Automated or scripted ordering activity designed to exhaust number pools or manipulate pricing and availability;
• Usage patterns consistent with credential stuffing, account takeover attempts, or OTP interception.

We reserve the right to define and adjust misuse thresholds at our sole discretion, without prior notice. Accounts identified as abusive may be suspended immediately, with any remaining balance subject to forfeiture pending investigation.

6. Limitation of Liability

Our service is provided 'as is' and 'as available'. We expressly disclaim all warranties, whether express or implied. To the maximum extent permitted by applicable law, we shall not be liable for:

• Blocking, restriction, or limitation of accounts on external platforms (WhatsApp, Telegram, Google, financial institutions, etc.);
• Refusal of registration, validation, or access by third-party services;
• Numbers with a history of previous use, including prior use as a payment key (e.g. PIX) or account recovery method;
• SMS delivery failures or delays caused by operators, routing issues, or external platforms;
• Refusal of SMS delivery motivated by a suspicious IP, device fingerprint, or user risk profile identified by the destination platform.
• Losses, damages, or legal consequences arising from the user's violation of these Terms, applicable law, or third-party rights;
• Interruptions or unavailability of the service due to maintenance, technical failures, force majeure events, or third-party infrastructure issues.

The use of the service is strictly at the client's sole risk and assumed responsibility.

7. Blacklists and Number Risks

The user acknowledges that certain numbers may be flagged, restricted, or blacklisted by third-party platforms based on their proprietary risk assessment algorithms. The user assumes full responsibility and all associated risks when licensing and utilizing these numbers.

8. Security and Privacy

We employ industry-standard security measures and encryption protocols to protect transactions. However, the user acknowledges that no system is entirely immune to security breaches. We do not directly store or process sensitive payment data, relying on PCI-DSS compliant third-party processors.

9. Refund Policy

All purchases are generally final and non-refundable. Exceptional refund requests are processed solely as platform credits, never to the original funding source, and are strictly contingent upon the following evidentiary requirements:

10. Account Suspension and Termination

We reserve the right to suspend or permanently terminate any user account at any time, with or without prior notice, and without liability, for any reason including but not limited to: material violation of these Terms; suspected fraudulent activity or misrepresentation; initiation of payment disputes, chargebacks, or unauthorized reversals; abusive conduct; or where continued access, in our sole judgment, poses a risk to the platform, third parties, or our compliance obligations. Upon termination due to fraud or Terms violations, any remaining account balance may be forfeited. In non-violation terminations, we will make reasonable efforts to return the available balance subject to applicable processing thresholds. Termination does not release the user from any obligation or liability accrued prior to the termination date.

11. Law Enforcement Cooperation and Legal Compliance

We actively cooperate with governmental authorities, law enforcement agencies, judicial bodies, and competent regulatory institutions, both domestic and international, in any investigation, legal proceeding, administrative inquiry, or official request related to activities conducted through the service. In such circumstances, we may be required, and reserve the right, to disclose user data, account metadata, transaction records, IP addresses, device identifiers, session logs, and any other pertinent information, without prior notification to the user, to the extent permitted or mandated by applicable law. By using this service, the user expressly acknowledges and accepts that:

• All activity on the platform is logged and may be retained for a period determined by applicable legal or regulatory requirements;
• The use of the service for any criminal, fraudulent, or otherwise unlawful purpose may result in the disclosure of identifying information to competent authorities, including domestic and international law enforcement agencies;
• We may take unilateral action — including account suspension, balance freeze, and referral to authorities — upon receiving credible evidence or lawful legal direction indicating misuse of the platform;
• We accept no liability for any legal, financial, or reputational consequences arising from the user's activities on the platform or from our compliance with lawful legal obligations.

12. API Access and Integration Terms

Access to the platform via API is subject to all provisions of these Terms and, additionally, to the following specific conditions:

• API credentials (keys, tokens, authentication secrets) are personal and non-transferable; public disclosure or unauthorized sharing is strictly prohibited;
• API access is designed to support reseller integrations, loyalty and discount programs, and automated workflows; commercial resale of platform services via API is expressly permitted, provided the integrator and its downstream users comply fully with these Terms and all applicable laws;
• API usage is subject to a rate limit of 20 requests per second per account; exceeding this threshold or circumventing it through technical means (e.g., multi-account farming, request splitting, or credential sharing) constitutes a material breach of these Terms and may result in immediate suspension;
• Automated load testing, stress testing, or penetration testing, or systematic probing of the API infrastructure without prior written authorization is prohibited;
• We reserve the right to revoke API access at any time and without prior notice upon detection of misuse or any activity inconsistent with these Terms;
• Integrators and developers who expose platform functionality to their own end users assume full, joint responsibility for ensuring those end users comply with these Terms.

13. KYC, AML, and Regulatory Compliance

We reserve the right to implement Know Your Customer (KYC) and Anti-Money Laundering (AML) verification procedures at any time and for any user account, particularly in response to regulatory requirements, high transaction volumes, or suspicious activity. This may include identity verification, documentation of the source of funds, and enhanced due diligence. Failure to comply with a KYC/AML request within the prescribed timeframe may result in temporary suspension, permanent termination, and potential forfeiture of balance pending regulatory review. Access to the service by individuals or entities located in or associated with jurisdictions subject to international sanctions (including those designated by OFAC, the European Union, or the United Nations) is strictly prohibited. We reserve the right to block, suspend, or terminate any account we reasonably believe to be associated with a sanctioned entity, restricted jurisdiction, or unlawful financial activity.

14. Force Majeure

We shall not be held liable for any delay, interruption, or failure in the provision of the service resulting directly or indirectly from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, declared or undeclared wars, pandemics, civil unrest, governmental actions or restrictions, legislative changes, telecommunications or internet infrastructure failures, power outages, cyberattacks (including DDoS events), third-party provider failures, or carrier-level disruptions. In the event of a force majeure occurrence, our obligations under these Terms shall be suspended for the duration of the event, and no liability, compensation, or credit shall accrue in favor of the user during such period.

15. Modifications to Terms and Pricing

We reserve the right, at our sole and absolute discretion, to modify, amend, adjust pricing, or update these Terms of Service at any time, without prior notice. Continued use of the platform following such changes constitutes binding acceptance of the revised terms.

16. Acceptance of Terms

By accessing or using the service, depositing funds, or licensing a virtual number, the user represents and warrants that they have read, comprehensively understood, and unequivocally accepted these Terms in their entirety.

17. Intellectual Property Rights

All content, trademarks, logos, service marks, visual interfaces, and software architecture associated with the platform are the exclusive intellectual property of TrueOTP LLC (or its licensors). The user is granted a limited, revocable, non-exclusive, non-transferable license to access and use the service strictly in accordance with these Terms. No ownership rights, title, or interest are conveyed to the user.

18. Indemnification

The user agrees to defend, indemnify, and hold harmless TrueOTP LLC, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, fines, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to the user's violation of these Terms, misuse of the service, or infringement of any third-party rights.

19. Arbitration and Waiver of Class Action

Any dispute, claim, or controversy arising out of or in connection with these Terms or the use of the service ('Dispute') shall be resolved exclusively through final and binding individual arbitration, rather than in court. BY AGREEING TO THESE TERMS, YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE PROCEEDING AGAINST US. The arbitration shall be conducted by a recognized arbitration institution under its then-current applicable rules, in the English language. The arbitrator's award shall be final, binding, and enforceable as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, either party retains the right to seek emergency injunctive or other equitable relief from a court of competent jurisdiction solely to prevent imminent irreparable harm, pending final resolution of the Dispute through arbitration.

20. Governing Law and Dispute Resolution

These Terms and any action related thereto shall be governed by, construed, and enforced in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of Delaware.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by an arbitrator or court of competent jurisdiction, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
